For schools like Western, if student/athletes are legally classified as employees that would be a potential death nail for athletics. Just paying each athlete minimum wage and providing benefits as most employers do would be prohibitive for schools like Western. You throw in Title IX requirements which will not allow us to cut non-profitable women’s sports participants without cutting the equivalent number of male student/athlete opportunities and it makes it impossible to sustain a D1 athletic department. If we keep football with 63 scholarship and men’s basketball with 15 scholarships, that is 78 scholarships and we would have to give 78 women’s scholarships for a total of 156 scholarships for our student/athlete employees. Baseball would have to go away on the men’s side. At $7.25 per hour and 40 hrs per week each athlete would be paid $290 per week or $15,080 per year plus benefits, employer paid SS taxes and Medicare taxes. Salary alone would be $2,352,480 per year plus benefits and employer paid taxes with 156 employees. We would also not qualify to be D1 anymore, because we would not have 14 teams competing at the D1 level. Therefore Western would have no choice and might have to cut all intercollegiate sports. I see no way to make a model work where we have to treat athletes like employees and pay them. Many people will be emotional about this if the time comes but what choice would a school like Western have.
Well meaning people and government bureaucrats think that they are helping folks but if this is eventually ruled the law of the land by the courts, many opportunities will be eliminated for student athletes. This will destroy FCS football and only the ultra rich P5 schools will be able to afford to field sports teams. Unless an athlete is considered the best of the best elite athlete, there will be no market for their skills. Unintended consequences.
